Rental terms
This English translation is provided for your convenience. In case of any differences between the English and German versions, the German version shall prevail.
These rental terms apply when you book Schwanenvilla Kitzeberg through our website. For bookings made through Airbnb, FeWo-direkt or other booking platforms, the agreements made through those platforms and any other rules validly agreed upon apply.
1. Who is the landlord?
The landlords are the people identified as landlords in our legal notice.
2. When does your booking become binding?
- When you submit a reservation request through our website, you make us a binding offer to rent Schwanenvilla Kitzeberg for the specified dates and guests.
- Until you receive our booking confirmation, you can change or withdraw your request using your personal link. Any change counts as a new reservation request.
- We have 72 hours from receiving your reservation request to accept it. If your requested stay begins sooner, the acceptance period ends no later than the start of that stay. If we have not confirmed your booking by then, your request expires.
- A rental agreement is formed only when our booking confirmation reaches you by email. An automatic acknowledgement that we have received your request is not a booking confirmation.
- A non-binding enquiry is not a booking and does not reserve the requested dates for you.
3. What is included in the price?
- You rent Schwanenvilla Kitzeberg for the confirmed dates and registered guests. The furnishings and services included are described on our website as it stood when you booked and in your booking confirmation.
- The confirmed total price includes accommodation and end-of-stay cleaning. We do not charge any additional mandatory fees, and we do not require a security deposit.
- We cover the local visitor tax (Kurabgabe) for you and your fellow guests and pay it to the relevant local authority. There is no extra charge to you.
4. When do you have to pay?
- Please transfer the full amount within 7 days of receiving your booking confirmation to the bank account specified in it.
- If you book 7 days or less before arrival, the full amount is due immediately. We recommend an instant bank transfer in this case.
- We must receive the full amount due before you receive the key. Your statutory rights, for example in the event of defects in the accommodation, remain unaffected.
- If you do not pay on time, we will give you a reasonable additional period to pay. If you still do not pay, we may withdraw from the agreement in accordance with German law and, where applicable, claim compensation for any loss caused.
5. Can you withdraw from your booking?
For holiday accommodation booked for specific dates, there is no statutory 14-day right of withdrawal (section 312g (2) no. 9 of the German Civil Code, BGB). However, you can cancel your booking under the rules below.
6. What happens if you cancel or change your booking?
How to cancel
- You can cancel a confirmed booking before your stay begins by email or through your personal guest page.
- Your cancellation takes effect as soon as we receive your clear notice of cancellation. You do not need to wait for our confirmation.
- Before you submit a cancellation through your guest page, we will show you the estimated cancellation charges and refund. We will then review the cancellation and refund calculation ourselves and confirm the final figures by email.
How much does cancellation cost?
If you cancel your entire booking before arrival, we will refund the end-of-stay cleaning charge in full. The following percentages therefore apply only to the accommodation price, excluding end-of-stay cleaning:
| When we receive your cancellation | Percentage of the accommodation price we keep |
|---|---|
| At least 60 days before arrival | 0% (free cancellation) |
| 59 to 30 days before arrival | 30% |
| 29 to 14 days before arrival | 60% |
| 13 days before arrival up to and including the arrival date | 90% |
These periods are calculated in calendar days. We count the days between the date we receive your cancellation and your agreed arrival date; the arrival date itself is not counted.
You may demonstrate that your cancellation caused us no loss or a substantially smaller loss. If so, you only have to pay the correspondingly lower amount.
When will you receive your refund?
- We will refund any amount initially due to you following cancellation within 14 days of receiving your cancellation, to the extent that you have already paid it. This includes the end-of-stay cleaning charge.
- If you do not check in at any point during your booked stay and have not cancelled in advance, the cancellation charge is 90% of the accommodation price. We will refund the end-of-stay cleaning charge in full. We will calculate any refund and return any amount due within 14 days after the originally scheduled end of your stay.
- If we manage to rent out any of the cancelled nights to other guests, we will deduct the corresponding rental income from your cancellation charges. We may subtract any additional costs directly caused by the replacement booking from that income.
- After your originally scheduled stay has ended, we will check whether the replacement booking entitles you to any further refund. We will transfer any additional amount due within 14 days. The total amount refunded will never exceed what you paid for the cancelled booking.
If you leave early or want to change your booking
- If you leave early for personal reasons, do not use some of the booked nights, or arrive with fewer guests, the agreed price generally remains payable. We will deduct any expenses we save and any income from renting the accommodation to someone else, to the extent required by law.
- If you would like to change your dates, please contact us. Changes are only possible with our agreement, and you are not entitled to change your booking free of charge. We will confirm any new dates and, if applicable, the revised price.
- Your statutory rights, particularly in the event of defects in the accommodation, remain unaffected.
We recommend taking out travel cancellation insurance.
7. When can we end the booking?
- If we cannot provide all or part of the accommodation, for example because of serious water damage, we will inform you as soon as possible. We will refund any payments for accommodation or services that we cannot provide. Any further statutory rights you may have remain unaffected.
- If there is good cause, we may terminate the rental agreement with immediate effect in accordance with German law. This may apply, for example, if guests seriously or repeatedly breach the house rules or if substantially more people stay overnight than are permitted. We will give you a warning beforehand if required by law.
- Even after such a termination, we may still be entitled to payment or compensation under the law. We will deduct any expenses we save and any income from renting the accommodation to someone else, to the extent required by law.
8. Who may stay at Schwanenvilla, and when can you arrive?
- No more than five guests may stay overnight at Schwanenvilla, including no more than four adults. The person making the booking must be at least 18 years old, and at least one overnight guest must also be an adult.
- Only registered guests may stay overnight. Any additional overnight guests require our prior consent, and the maximum occupancy must not be exceeded.
- Day visitors are welcome as long as they do not cause a disturbance and follow the house rules.
- You may not sublet the accommodation or allow other people to use it independently without our consent.
- Check-in is from 5:00 pm; check-out is by 11:00 am. We will let you know how to collect the key in good time before arrival.
- You and your fellow guests must provide the information required by law for registration forms, the visitor tax and the ostseecard (local visitor card), and present any documents required by law.
9. Which house rules apply?
Our house rules, in the version agreed at the time of booking, apply during your stay. You agree to them separately when submitting your reservation request. Please make sure that your fellow guests follow them too.
10. Who is liable for damage?
- Please treat Schwanenvilla and its furnishings with care. If you notice any damage, defect or technical fault, let us know immediately. Take reasonable steps to help prevent further damage.
- You must pay for damage for which you are legally responsible. This may also include damage caused negligently or intentionally by your fellow guests, where you are legally responsible for it, and necessary additional costs arising from excessive soiling or a lost key. You do not have to pay for normal wear and tear.
- We are fully liable for damage caused intentionally or through gross negligence, as well as for death, personal injury or harm to health caused by our fault.
- If we breach an essential contractual obligation through ordinary negligence, our liability is generally limited to loss that is typically foreseeable under an agreement of this kind. For other loss caused by ordinary negligence, our liability is excluded to the extent permitted by law.
- Your statutory rights in the event of defects in the accommodation remain unaffected. This also applies to claims for which the law makes us liable even without fault, and to other mandatory liability claims.
11. Which law applies?
German law applies. Any mandatory consumer protection rights to which you are entitled under the law remain unaffected.
